Spousal Maintenance in Colorado

There are two types of spousal maintenance in Colorado. These are statutory maintenance and contractual and non-modifiable spousal maintenance.

The court may award statutory maintenance during or at the end of a divorce case. While contractual and non-modifiable maintenance is agreed upon between spouses and entered as a final agreed order.

Statutory Maintenance in Colorado

Statutory maintenance may be temporary or permanent. Temporary maintenance is only awarded during the pendency of a divorce.

Permanent maintenance is typically long-term spousal maintenance. Spouses can be awarded lifelong maintenance in Colorado, but it is rare.

Colorado has statutory guidelines and a term chart addressing marriages between three and 20 years. The court is encouraged to follow the guidelines when considering a spousal maintenance award but is not obligated to do so.

Statutory Guidelines in Colorado

Colorado’s statutory guidelines recommend spousal support run for a percentage of the length of a marriage. As stated, only marriages between three and 20 years are charted.

For example:

  2. Marriages of 20 years may qualify for alimony up to 10 years or 50% of the marriage

When a guideline recommendation does not produce a fair and equitable amount and term of spousal maintenance, the court may choose to deviate from the chart. This may be the case in a marriage lasting 20 years or more.

Marital misconduct is not a factor in spousal support awards.
